Terms & Conditions

Welcome to the TOPSHOP.COM terms and conditions, which apply to all items ordered from TOPSHOP.COM. Please read through them carefully before placing your order. By using this website and/or placing an order you agree to be bound by the terms and conditions set out below. Please also read our Privacy Policy regarding personal information provided by you.

We may change these terms and conditions from time to time without notice to you. Changes will apply to any subsequent orders received. Once your order has been confirmed, we will not be able to make any changes to the terms that apply to that order.

Your Delivery

UK DELIVERY OPTIONS

 

We offer two delivery options for UK customers: (1) Standard Delivery and (2) Tracked and Faster Delivery. Charges apply to both options.

For further information, including the costs and estimated delivery times, please see the Delivery section of our FAQs.

Alternatively, you can collect your items from one of our stores in the UK (excluding stores in department stores).  For further details, please see the Collect From Store section of our FAQs. If you choose this option, we will keep your order in store for 10 calendar days after it has arrived. If the order is not collected within the 10 days, we will assume it is unwanted, cancel the order and issue a refund to your original payment method.

If you have any questions concerning delivery of your order, please contact our Customer Services department.

 

 

OTHER INFORMATION 
Please note, no changes can be made to the delivery address after the order has been placed.

UK Bank holidays are not classified as delivery days, please allow an extra working day for deliveries over UK Bank Holidays detailed below: 

 

• 25th March 2016 - Good Friday
• 28th March 2016 - Easter Monday
• 2nd May 2016 - Early May Bank Holiday
• 30th May 2016 - Spring Bank Holiday
• 29th August 2016 - Summer Bank Holiday
• 26th December 2016 - Boxing Day

Please allow an extra working day for deliveries over International Bank Holidays.

 

You can now order products on our website and collect them from a Topshop or Outfit store, along with other convenient Topman pick-up locations, instead of having them sent to your home.



This service is available at mainland UK and Northern Irish stores but excludes the Republic of Ireland as well as some areas of the Highlands.


HOW IT WORKS

1. Choose your store
Use the store finder within the checkout to find your nearest participating store. We now have two Collect From Store delivery options: Standard Delivery: Free or Express Delivery: £3.00.

Collect From Store Standard Delivery: FREE
If you select this option, we will aim to deliver your order between 3 and 7 days from the date you placed it.  However, sometimes during sale periods or other busy periods deliveries might take longer.  Your estimated delivery date will be indicated on the Store Finder page within the checkout.

Collect From Store Express Delivery: £3.00
Order by 9pm (weekdays) or 5pm (Sunday) for next working day delivery.



2. We'll email you
We'll send you an email when your order is ready to collect. After you have received it, you can collect your order at any time during the day, according to the store opening hours. For details, please see our store finder.



3. Collect from store
Come into store to collect your order, bringing your confirmation email and the card that you paid with. If you have paid by Paypal please bring the card that links to your Paypal account. We will keep your order in store for ten calendar days after it has arrived. If the order is not collected within the 10 days, we will assume it is unwanted, cancel the order and issue a refund to your original payment method.



4. Returns
We have the same returns policy for Collect From Store as in-store returns. You can return your order within 1 month of receipt. Please note this date begins on the date that we send you an order dispatch.



Products can be returned either to a Topshop store, or to Topshop.com by post or Collect +. Products can’t be returned to Topman or Outfit collection points.

We offer two delivery options for international customers outside the United Kingdom: (1) Standard Delivery and (2) Tracked and Faster Delivery. Charges apply to both options.

Please note that we do not deliver to the Channel Islands and BFPO addresses.

FREE STANDARD SHIPPING

 

1.By taking advantage of the Free Delivery offer (the “Offer”) you agree to these terms and conditions.

 

2.The Offer entitles you to free standard delivery within the UK or internationally on all online orders at www.topshop.com.

 

3.The Offer applies to the standard delivery service only for International orders and the standard home or standard collect from store delivery services for customers shipping within the UK.

 

4.Topshop’s normal refund and returns policy applies.

 

5.This Offer cannot be used in conjunction with any other offer or promotion and cannot be exchanged for cash.

 

6.Topshop reserves the right to (i) cancel this Offer at any time; (ii) refuse to allow any individual to participate in this Offer (iii) decline to accept order where, in its opinion, an Offer code is invalid for the order being placed and (iv) amend these terms and conditions (and will use reasonable endeavours to notify changes to all customers).

 

7.These terms and conditions shall be governed by and construed in accordance with English law and the English courts shall have exclusive jurisdiction in the event of a dispute.

Track Your Order

If you have selected Standard delivery go to www.hermes-europe.co.uk and use the tracking number and delivery postcode provided in your despatch email. Please allow 36 hours from receipt of the email before tracking your order.

 

Standard delivery orders to most areas of Mainland UK should arrive within four working days.  Exceptions to this are deliveries to AB and DD postcodes, Highlands and Islands and Northern Ireland.  Deliveries to these areas will take up to seven working days to arrive.

 

HAVING TROUBLE TRACKING YOUR ORDER?

We will check your order status and give you an update. Please contact us using our online feedback form with the date your order was placed, your reference number for each order, your full name, billing address and phone number.

 

Please allow six working days before querying your UK order, or eight working days before querying your Northern Ireland, AB postcodes, Highlands and Islands orders.

If you have selected a specific delivery day log on to http://www.myyodel.co.uk and use the tracking number provided in your despatch email or click the link in your despatch email. Please allow 24 hrs from receipt of the email before tracking your order. Our couriers will send you a text message to re-confirm the delivery day you selected. Please note that your order can arrive at any time between 7am and 9pm on your Nominated Delivery Day, however, they can deliver later in the evening during busier periods. In order to track your order with us, you will need to have your tracking number with you. This can be located on your despatch confirmation email.

 

If your tracking number begins with RML, unfortunately, we are unable to track these parcels at present.

 

Most parcels will reach their destination within 2 weeks, however, some destinations may require additional time allowed for parcels to arrive.

Price & Payment Options

Payment Options

 

We accept American Express, Visa, Visa Delta, Visa Electron, Maestro, MasterCard, Solo, Arcadia Group Store cards, PayPal, Alipay and China Unionpay.

If you have paid on your debit, credit or charge card you will only be charged once the goods have been dispatched to the delivery address. We will email you to confirm dispatch.

The prices shown on our website include any VAT (or similar sales tax) at the prevailing rate for which we are responsible as the seller. The amount you pay will be the price indicated plus any delivery charges. The delivery charges will depend on the delivery option that you choose and will be shown during the checkout process.  


FURTHER INFORMATION FOR OVERSEAS CUSTOMERS

We charge you for your order in Pounds Sterling. The actual price charged to overseas customers will be subject to the exchange rate applied by the customer's credit or debit card company. Please note that customers outside of the European Union will be liable for any import duty or other taxes, fees and charges that are applied by customs or other authorities in the country of receipt. If you are unsure about whether these duties, taxes and charges might apply to your order, you should contact your local tax or customs authorities.

 

All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to, or does not for any reason, authorise payment then you will be notified of this immediately at the check-out stage.

In assessing your request for goods or services, we may use your information for the purposes of the prevention and detection of fraud. One of the purposes for which we may disclose your address and postcode details is to check against the IMRG Security Alert or any other Fraud Prevention Scheme. At all times where we disclose your information it will remain secure. HOW IT WORKS

When you reach the checkout process at Topshop.com (or any participating retailer) you will have the opportunity to register for either Verified by Visa or MasterCard SecureCode. Simply sign-up for the service following the online instructions that are linked directly to your card issuer, set up your new personal password once your card issuer has confirmed your identity, and continue shopping.

This is a one-off registration process, so you will be able to use the same password for all future purchases you make with participating retailers.

Student Discount

STUDENT DISCOUNT ONLINE
Student Beans members and Unidays members receive 10% off purchases with a valid Student Beans or Unidays membership. To redeem your discount online login through the Student Beans or Unidays verification platforms. Discount is not available on giftcards or store card payments. We reserve the right to terminate this discount without notice. Discount is only valid for Student Beans members and Unidays members and is non transferable.

STUDENT DISCOUNT INSTORE
Students receive 10% off purchases with any valid student card. To redeem the discount please show a valid student card at the checkout. Discount is not available on giftcards or store card payments. We reserve the right to terminate this discount without notice. We reserve the right to not accept ID that we deem invalid or fraudulent.

Returns

We guarantee to refund any item you are not completely happy with when you return it to us in saleable condition within 14 days of receipt, in the case of returns by post, and 28 days of receipt, in the case of returns to store (excluding department stores). To return an item by post, use the freepost returns label included within your order. See Returns by post (all countries) for details. Refunds will be credited to your original method of payment. Orders paid for using split payment (part gift card, part other payment method) will always be refunded to the gift card(s) first. Any remaining balance will be paid back to the other payment method originally used.

In the interests of hygiene we do not offer refunds on underwear or swimwear if the hygiene seal has been removed, or pierced jewellery or cosmetic products if they have been used or the hygiene seal is broken, unless they are of unsatisfactory quality or unfit for purpose. Please also note that items must be returned with all of the barcode tags intact and with the despatch note you received enclosed.

Please note: Not all items can be returned to store.  All items that are part of our concession brand collections can only be returned by post. These items are clearly marked on your despatch note with an ‘**’ at the end of the product description. Orders purchased using Buy Now Pay Later (Klarna) can only be returned to the website.

 

In addition the following items can only be returned by post:

-Unique, Emerge & Designer collections
-All concessions and DCK
-Dress Up & Limited Edition dresses

You also have the right to cancel your contract with us and return your items by post within 14 calendar days from the day after the date you received your order. Please see RIGHT TO CANCEL (EU CUSTOMERS) for details.

Your statutory rights are not affected by our returns policy.

For your convenience, customers in the UK and Republic of Ireland can go to their nearest store to return an item, excluding those in department stores. Please ensure that you take your despatch note with you as your proof of purchase. You will also require the card that was used to purchase the order online. If you are not the cardholder for the order, they will need to be present at the time of return to store to accept the refund back onto their credit/debit card.

International customers - Please note: unfortunately we currently do not offer refunds or exchanges on items bought on our website to stores outside of the UK and Republic of Ireland. We are sorry for any inconvenience this may cause you

 

Republic of Ireland customers - Please note: refunds in-store for items bought on-line will be paid in Euros by applying Arcadia's current commercial exchange rate to the sterling price for the item on your despatch note.

 

International customers - Please note: unfortunately we currently do not offer refunds or exchanges on items bought on our website to stores outside of the UK and Republic of Ireland. We are sorry for any inconvenience this may cause you.    

You can return an item by post within 14 days of receipt. Customers in the UK will receive a freepost returns label with their order.  International customers will not receive a freepost returns label and are required to return unwanted orders at their own cost.

Please allow 28 days from the day the parcel is posted for your refund to be processed. We will email you to let you know once your parcel has been received and your refund has been processed.

The refund will be processed once your goods are received into our warehouse. Please note that it may take 2-3 working days for the refund to show in your account. Each item returned is refunded separately, and will show on your statement as a refund / credit from TOPSHOP.COM. Refunds will be credited to your original method of payment. Orders paid for using split payment (part gift card, part other payment method) will always be refunded to the gift card(s) first. Any remaining balance will be paid back to the other payment method originally used. If your card expires before we process your refund please contact our Customer Services Team with your order number, postcode and new card details.

RETURNING GOODS BOUGHT AS SPECIAL OFFERS

If you return a single item bought as part of a multi-buy discount offer (for example 'buy 2 for £20.00') you will be refunded the full price of that item less the total discount given in the offer. If you return all items purchased with the multi-buy discount you will be refunded with the full multi-buy value.

For combination purchases ("buy one, get one free" or "get the lowest priced item free"), you must return any free items or vouchers back for us to process a refund.

 

RETURNING GOODS WHICH ARE OF UNSATISFACTORY QUALITY OR UNFIT FOR PURPOSE

Customers in the UK can return these items to us using the freepost returns label enclosed with their order or download a freepost returns label here. Alternatively you can return them to our UK stores or EIRE stores (excluding those in department stores).  Refunds will be credited to your original method of payment.

International customers can only return these items by post.

In addition to our returns policy, if you are a customer in the European Union you have the right to cancel your contract with us within 14 calendar days from the day after the date you received your order. This right does not apply to the following items: (1) items that have been sealed for hygiene reasons (e.g make-up, underwear, swimwear or pierced jewellery) if the seal has been broken; (2) CDs and DVDs if the seal has been broken; and (3) items that have been made to the customer’s specification or that are personalised. You will be responsible for the cost of returning a cancelled order to us.

To exercise your right to cancel follow the steps below:

1. Print off the cancellation form provided in the “Information About your Right to Cancel” document in your order confirmation email and include it with the items when you return them. You can also access a copy of the Cancellation Form here. Alternatively, write to us by email (customer.care@arcadiagroup.co.uk) or include a letter with the items when you return them. Please state that you wish to cancel your contract and include your full name, address and order number.  

2. Return the items to us by post at your own cost and no later than 14 calendar days after the day that you sent us the Cancellation Form or other written notice of your cancellation. Please download a returns label here and once completed, affix it to the parcel and take it to your local posting office.  

We will refund to you the price paid for the items and (unless you did not pay for delivery) the delivery charges that you paid up to a maximum amount of the cost of our Standard Delivery option. You will be refunded to your original method of payment within 14 calendar days of our receipt of the cancelled items or, if earlier, within 14 days from the day we receive proof of return from you. Orders paid for using split payment (part gift card, part other payment method) will always be refunded to the gift card(s) first. Any remaining balance will be paid back to the other payment method originally used. If we do not receive the cancelled items back, we may arrange to collect them from you at your cost.



Product Information

We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery.

All sizes and measurements are approximate, however we do make every effort to ensure they are as accurate as possible. Unless otherwise stated, sizes indicated are UK sizes. Please refer to the size guide for clarification.

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. We reserve the right to refuse orders where product information has been mis-published, including prices and promotions.

Topshop does not allow its cosmetic products to be tested on animals, either during the production process or in the finished state.



Any items ordered remain our property until we receive full payment.



Purchase of Products

When you place an order on our website we shall email you an order confirmation email. Our acceptance of your order does not take place until despatch of the order, at which point the contract for the purchase of goods will be made and you will be charged.

Once you have checked out and you have received your order confirmation email you will not be able to make any changes to your order so please make sure that everything is correct before clicking the ‘CONFRIM & PAY’ button.

Any discounts triggered by the entry of a promotional code will not be applied until the order is accepted but will be detailed on the invoice.

We reserve the right to refuse an order. Non-acceptance of an order may, for example, result from one of the following:

    * The product ordered being unavailable from stock

    * Our inability to obtain authorisation of payment

    * The identification of an error within the product information, including price or promotion

    * If we suspect any fraudulent activity

If there are any problems with your order we shall contact you. We reserve the right to reject any offer to purchase by you at any time. We will take all necessary measures to keep the details of your order and payment secure..

Prices are subject to change without notice. These changes will not affect orders that have already been despatched. Prices are inclusive of VAT (where applicable).

Goods are subject to availability. As there is a delay between the time when the order is placed and the time when the order is accepted, the stock position relating to particular items may change. If an item you have ordered becomes out of stock before we accept the order we shall notify you as soon as possible and you will not be charged for the out of stock items.

We continually update our website. From time to time our stores may run special local promotions (which may not be available on our website) or we may offer special discounts online that are not available in stores. Additionally, some website promotions may not be available to customers in particular jurisdictions.

We ask for your name, telephone number, home address, email address and age for competitions, prizedraws, or newsletters or personal shopper sign ups. When a purchase is made on our site, in addition to the above, we also ask for delivery address, and payment method details. WHAT THE DATA WILL BE USED FOR?

Top Shop/Top Man Limited is a registered data controller under the Data Protection Act 1998 (the "Act"). We comply with the standards, procedures and requirements laid down in the Act to ensure that the personal information you give us is kept secure and processed fairly and lawfully.

WHAT INFORMATION DO WE SHARE WITH OTHERS?

We may contract with other companies to provide certain services, including credit card processing, shipping, name and address verification, email distribution, market research and promotions management. We provide these companies with only the information they need to perform their services and work closely with them to ensure that your privacy is respected and protected. These companies are prohibited by contract from using this information for their own marketing purposes or from sharing this information with anyone other than Topshop. We may pass your information onto Arcadia Group (USA) Limited, which operates our US retail stores, which will treat the information in a manner consistent with this Privacy Policy Statement, such as to accept returns for products purchased through the Website. We will not pass your information on to any other Arcadia Group companies or other third parties for marketing purposes unless you have agreed for us to do so.

One of the purposes for which we may disclose your address and zip code details is to check against the IMRG Security Alert or any other Fraud Prevention Scheme. We may also disclose specific information upon governmental request, in response to a court order, or when required by law to do so. We may also share information with companies assisting in fraud protection or investigation. We do not provide information to these agencies or companies for marketing or commercial purposes.

PRIVACY OF CHILDREN ON OUR WEBSITE
Our Website is not intended for use by children under the age of 14, and we will not knowingly collect any information from any person below the age of 14.

SALE OF ASSETS

In the unlikely event that Topshop or substantially all of its assets are acquired, customer information will of course be one of the transferred assets.


KLARNA

We work with Klarna AB to offer our customers more convenient methods of payment. Klarna AB (“Klarna”) is a provider of financial services. Klarna's principal place of business is at Sveavägen 46, 111 34 Stockholm, Sweden. Klarna is registered with the Swedish companies register under the registration number 556737-0431 and licensed by and under the supervision of the Swedish Financial Supervisory Authority (www.fi.se), Box 7821, 10397 Stockholm, Sweden, and the Swedish Data Protection Authority (http://www.datainspektionen.se/in-english/), Box 8114, 10420 Stockholm, Sweden.


We need to provide Klarna with certain information about you and the order to enable Klarna to assess whether you qualify for their credit products. We need to transfer to Klarna account details such as your name, address, email address, phone number, and payment history, as well as your order details, such as payment method, shipping details, what was ordered, and similar. This will not be done if you do not select Klarna as your payment method. The further use of this data will be governed by Klarna’s Privacy Policy.

WEEE Compliance

UK Waste Electrical and Electronic Equipment (WEEE) Regulations (SI 2006 No. 3289)

 

So that you can get your old electrical products recycled, Arcadia have contributed toward the development of recycling collection points (known as ‘Designated Collection Facilities) throughout the UK through our membership of the Distributor Take Back Scheme (DTS).

 

UK households dispose of over 1.2 million tonnes of electrical and electronic waste every year. Research Feedback Prize Draw Terms & Conditions


1. By providing feedback ("Feedback") with your name and email address you will be entered into the free prize draw (the "Prize Draw") and agree to these terms and conditions.

2. This Prize Draw is open to residents of the British Isles aged 16 or over, except for employees of the Arcadia Group, their families, agencies or anyone else associated with this Prize Draw.

4. To enter you must register online at www.topshop.com/feedback provide us with your details and complete the Feedback.

5. This Prize Draw opens at 00:00 (GMT) on the first day of each calendar month and closes at 23:59 (GMT) on the last day of each calendar month. Only one entry per person per month.

6. There will be one winner (the “Winner”) selected each calendar month from all of the entrants in that calendar month across all of the Brands. The Winner will be drawn by an independent person at eDigitalResearch (our third party agent) on the first Monday of the calendar month following entry. Event Booking Terms and Conditions


1. These are the terms and conditions for the Topshop In Residence, Personal shopping appointments with Bay Garnett (the “Event”).

2. The Event consists of a series of 45 minute styling appointments (the “Appointments” each an “Appointment”) to take place on Monday 30th May 2016 at the times listed below at Topshop’s Oxford Circus store only (the “Store”). Appointments are available at the following times only:

 

• 10am – 10.45am
• 11am – 11.45am
• 12pm – 12.45pm
• 2.30pm – 3.15pm
• 3.30pm – 4.15pm
• 4.30pm – 5.15pm 
• 5:30pm - 6:15pm

 

3. One person per Appointment. In order to book an Appointment, participants must complete the online booking process by accessing the sign-up page for the relevant Appointment via https://bayygarnett.eventbrite.co.uk and paying £25 per person to secure the Appointment via the Eventbrite booking system.

4. Participants must be aged 16 or over. If you are under the age of 18, you must obtain consent from your parent/guardian to take part in this Event. By completing the online booking process you confirm that you have this consent.

5. The online booking process for all Appointments will open at 6pm (BST) on Monday 23rd May 2016 and will remain open until all Appointments have been allocated.

6. Appointments will be allocated on a first-come first-served basis. Appointments are not secured until they have been booked and confirmed via the Eventbrite booking system by email. No refunds will be provided in the event that a customer is unable to attend an Appointment and places on Appointments are non-transferable, non-cancellable and non-refundable (other than in accordance with point 8 below).

7. The following will be available at the Appointment:

a. Refreshments (alcohol for over 18s only, proof of age will be required) and sweet treats;
b. Participant will be entitled to redeem the £25 cost of the Appointment against Topshop items at the Appointment. Participant is responsible for any amount spent over £25. No cash alternative for any amount not redeemed;
c. c. A goody bag, the contents of which may vary and shall be decided at the sole discretion of Topshop.

8. In the event that an Appointment is cancelled by Topshop, participants with a confirmed Appointment will be entitled to receive a refund of the £25 paid to secure an Appointment. Refunds will be processed by Eventbrite.
